The Blink Score: A Racial Diversity Audit & Ranking of Ontario Law firms


In today's rapidly evolving and diverse society, the need for inclusivity and representation in all sectors, including the legal profession, has gained significant attention. As crucial players in the justice system, law firms have a responsibility to promote diversity and address longstanding disparities within their ranks. Researching to improve diversity efforts in law firms is paramount, not only to understand the existing challenges but also to identify effective strategies for fostering a more inclusive and equitable legal environment.

The Blink Score Project aims to contribute to this goal by analyzing the demographic makeup of law firms with 50 or more lawyers in Ontario(as listed by NALP Canada) and utilizing the Blink Score as a measurement tool to publish rankings that hold firms accountable to the public, clients, and their employees. By disseminating this data, the project seeks to create accountability through public discourse and increase representation by providing valuable insights to inform career advancement opportunities for racialized lawyers. Through shedding light on the current state of diversity in law firms and its impact on career progression, this research aims to drive positive change, promote transparency, and advance the principles of diversity, equity, and inclusion in the legal profession.

Understanding and fostering diversity in the legal profession is a multifaceted challenge that demands thoughtful analysis. Statistics Canada traditionally defines 'Visible Minorities' as individuals who are neither Caucasian in race nor white in color and do not identify as Indigenous Peoples, such as First Nations, Métis, or Inuit (Statistics Canada, 2019). However, for the purposes of the Blink Score project, the term racialized person or racialized group will be used. The Ontario Human Rights Commission notes that using the terminology “racialized person” or “racialized group” is more accurate than “racial minority”, “visible minority”, “person of colour” or “non-White”. Race is the socially constructed differences among people based on characteristics such as accent or manner of speech, name, clothing, diet, beliefs and practices, leisure preferences, places of origin and so forth. The Blink Score allows analysis of the demographic composition of law firms, particularly considering the representation of racialized persons. Through this report, we aim to share initial findings, express the project's significance, and identify methodological limitations that indicate the requirement for further in-depth, ethical, and well-funded research.

In the context of this analysis, the Blink Score was developed as a quantitative tool to evaluate racialized representation within law firms. Simply put, the Blink Score is a direct percentage representation of racialized lawyers in a firm. For instance, a 20% representation of racialized lawyers equates to a Blink Score of 20%, providing a straightforward, standardized method for evaluation. This allows our findings to be easily understood and meaningfully compared against other industry, provincial/state, and national benchmarks.
